Auch das Streikrecht ist ein in der Verfassung verankertes Grundrecht. Von der in Artikel 9 GG geschützten kollektiven Koalitionsfreiheit ist grundsätzlich auch das Streikrecht umfasst.

Der Haken für streikende Schüler besteht darin, dass das in Artikel 9 GG normierte Streikrecht ausschließlich Arbeitskampfmaßnahmen von organisierten Arbeitnehmern gegenüber Arbeitgebern betrifft. Ein „Streikrecht“, also ein Recht auf kollektives Fernbleiben vom Unterricht für ganze Schülergruppen oder Klassen, existiert im deutschen Recht nicht.

Schüler unterliegen in aller Regel der Teilnahmepflicht am Unterricht. Von dieser Teilnahmepflicht kann man nur in engen Ausnahmefällen und bei Vorliegen eines wichtigen Grundes suspendiert werden. Ein solcher Ausnahmefall ist bei einem von den Schülern ausgerufenen Streik, auch wenn damit die Durchsetzung von möglicherweise legitimen Zielen verfolgt werden soll, regelmäßig nicht gegeben.

Die Teilnahme an „wilden“ Streiks an der Schule führt vielmehr dazu, dass BAFöG-Bezieher, die an dem Streik teilgenommen haben, für den Zeitraum der Dauer des Streiks zur Rückzahlung der staatlichen Förderung verurteilt werden können (VGH Kassel, NVwZ-RR 1988, 88).
