Es darf bezweifelt werden, dass sich die Kultusministerkonferenz zum Demonstrationsrecht von Schülern heute noch ebenso einseitig positionieren würde. Hat man es doch bei der Frage des Teilnahmerechts an Demonstrationen auch während der Unterrichtszeit mit der gar nicht so untypischen Situation zu tun, dass zwei vom Grundgesetz geschützte Rechtspositionen miteinander konkurrieren.

Auf der einen steht der aus Art. 7 GG resultierende Verfassungsauftrag an den Staat für ein leistungsfähiges Schulsystem zu sorgen und damit auch den Bildungsauftrag gegenüber den Schülern nachzukommen. Aus diesem Erziehungsauftrag resultiert auch die allgemeine Schulpflicht eines jeden Schülers.

Auf der anderen Seite haben nun einmal auch Schüler ein Recht zu demonstrieren, und es steht nirgendwo in der Verfassung, dass man dieses Demonstrationsrecht nur in seiner Freizeit und keinesfalls während der Unterrichtszeit ausüben dürfe.
